Amigo Lingo – Terms of Service

Welcome to Amigo Lingo (“we,” “us,” “our”). By downloading, accessing, or using the Amigo Lingo mobile application (“App”) and related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use or access the Services.

1. Eligibility

  1. Age Requirement: You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction (e.g., under 16 in some EU countries), you may only use the Services under the supervision of a parent or guardian.
  2. Blocked Registrations: If our system detects that a user’s provided date of birth is 13 or under, we will block the registration process.

2. Accounts and Security

  1. Registration: To access certain features, you must register an account by providing accurate personal information. You are responsible for maintaining the confidentiality of your login credentials.
  2. Unauthorized Use: You agree to immediately notify us at [email protected] of any suspected unauthorized use of your account.

3. Subscriptions and Payments

  1. App Store Payments: All subscription purchases occur through the Apple App Store or Google Play Store. We do not handle or store payment details directly.
  2. Billing Cycle: Subscriptions may be billed on a recurring basis (monthly or yearly). You can manage or cancel your subscription through your App Store or Play Store account settings.
  3. Refunds: Any refund requests must be handled through Apple or Google, as per their respective policies.

4. License and Restrictions

  1. Limited License: We grant you a personal, non-transferable, non-exclusive, revocable license to use the App for your own language-learning purposes.
  2. Prohibited Uses: You agree not to:
  • Reverse engineer, modify, or create derivative works of the App.
  • Use the Services for any illegal or unauthorized purpose.
  • Interfere with or disrupt the Services or servers.

5. User Conduct

  1. Responsibility: You are solely responsible for all activities under your account.
  2. Prohibited Content: You must not transmit content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

6. Intellectual Property

  1. Ownership: All content, trademarks, and software related to Amigo Lingo are owned by or licensed to us. Unauthorized use of our intellectual property is prohibited.
  2. AI Conversations: AI-generated responses and transcripts may be stored for analysis and performance improvement. Refer to our Privacy Policy for details on data handling.

7. Disclaimer of Warranties

  1. As Is: The Services are provided “as is” and “as available” without warranty of any kind.
  2. No Guarantee: We do not guarantee that the Services will be error-free, secure, or uninterrupted.

8. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Services. Our total liability to you for any damages shall not exceed the amount paid by you (if any) for accessing the Services during the twelve (12) months immediately preceding the event giving rise to such liability.

9. Termination

  1. By You: You may discontinue use or request account deletion at any time.
  2. By Us: We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent activity.
  3. Effect of Termination: Upon termination, provisions that by their nature should survive (e.g., disclaimers, limitations of liability) shall remain in effect.

10. Governing Law & Dispute Resolution

  1. Governing Law: These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles.
  2. Dispute Resolution: Any disputes arising under or related to these Terms shall be resolved in the state or federal courts located in Georgia, and you consent to the personal jurisdiction of such courts.

11. Changes to the Terms

We may modify these Terms from time to time. If we make material changes, we will notify you (e.g., via email or an in-app alert). By continuing to use the Services after the updated Terms go into effect, you agree to be bound by the revised Terms.
